USCIS to Reject Certain I-129 Nonimmigrant Worker Petitions

USCIS has announced that as of August 5th, 2019, any Form I-129 Petition for a Nonimmigrant Worker will be rejected for not having the applicant's name, petitioner's name, or primary U.S. office address.

USCIS already rejects an application form for reasons such as lack of signature, outdated form edition, and incorrect payment amount. When an application is rejected, it is sent back to the applicant along with an explanation of why it was rejected. The applicant is free to resubmit their corrected application. Form I-129 is no different. 

The newly announced criteria for rejection adds another reason for petitioners to be very careful about form preparation.  It takes days or even weeks for USCIS to return a rejected petition.  If the petition is time-sensitive, the parties may not have time to file a new petition.  The consequences could be quite serious.
