Legal Requirements Suspended for F-1 Haitian Students




On August 3, 2021, DHS published a notice announcing that certain regulatory requirements for F-1 international students from Haiti will continue to be suspended until 02/03/2023.

Haitian F-1 students who are experiencing severe economic hardship as a result of the current crisis in Haiti will enjoy the following exemptions and benefits:

- May apply for employment authorization document (EAD)

- Will be considered to be engaged in a "full course of study" during the EAD's validity period by meeting the minimum course load requirement. 


Who may benefit from these policy changes:

- F–1 students whose country of citizenship is Haiti (regardless of country of birth)

- Must be present in the United States in lawful F–1 nonimmigrant student status as of August 3, 2021

- Must be enrolled in an a SEVP-certified school for F-1 students

- Who are experiencing severe economic hardship as a direct result of the current crisis in Haiti

- Includes those who are enrolled in approved private school in grades kindergarten through grade 12, public school in grades 9 through 12, and undergraduate and graduate education. 


DHS initially suspended these regulatory requirements for F–1 students experiencing severe economic hardship as a direct result of the January 12, 2010 earthquake in Haiti. The suspension has been extended several times since then.
